Terms of Service
Please read these Terms of Service (“Terms”) before using the THRYVE mobile application (the “App”). By creating an account or using the App, you agree to these Terms and our Privacy Policy.
1. Acceptance
These Terms are a legal agreement between you and the operator of THRYVE. If you do not agree, do not use the App.
2. Eligibility
You must be at least 13 years old (or the minimum age required in your country) to use the App. If you are under 18, you should use the App only with permission from a parent or guardian.
3. The App and your account
- THRYVE helps you track personal wellness activities such as journaling, gratitude, and fasting.
- You are responsible for keeping your login credentials secure.
- You agree to provide accurate registration information.
- You are responsible for activity under your account.
4. Acceptable use
You agree not to:
- Use the App for any unlawful purpose
- Upload content that is illegal, harassing, hateful, or infringes others’ rights
- Attempt to reverse engineer, disrupt, or gain unauthorized access to the App or its systems
- Use automated means to scrape or overload our services
- Create multiple accounts to abuse features or other users
5. Your content
You retain ownership of content you create in the App (journal entries, media, gratitude notes, etc.). You grant us a limited license to host, store, and process that content solely to operate the App (including optional cloud sync through Firebase).
You are solely responsible for your content. Do not store sensitive information you cannot afford to lose; back up important data and use cloud sync when available.
6. Health and fasting disclaimer
THRYVE is not a medical device and does not provide medical advice. Fasting, nutrition, and wellness features are for general informational and personal tracking purposes only. They are not a substitute for professional medical advice, diagnosis, or treatment.
Consult a qualified healthcare provider before starting or changing any fasting or diet program, especially if you are pregnant, nursing, under 18, have diabetes, an eating disorder, take medication, or have any medical condition. Stop fasting and seek medical help if you feel unwell.
You use fasting and wellness features at your own risk. We are not liable for health outcomes related to your use of the App.
7. Privacy
Our Privacy Policy explains how we collect, use, and protect your information. By using the App, you consent to those practices.
8. Third-party services
The App uses third-party services such as Google Firebase and Google Sign-In. Your use of those services may also be subject to Google’s terms and policies. We are not responsible for third-party services outside our control.
9. Availability and changes
We may modify, suspend, or discontinue any part of the App at any time. We try to keep the App available but do not guarantee uninterrupted or error-free operation.
10. Termination
You may stop using the App at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the App, users, or our legal obligations.
To request deletion of your account and associated cloud data, contact us as described in the Contact section or as stated in the Privacy Policy.
11. Disclaimers
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE SECURE, ERROR-FREE, OR THAT DATA WILL NEVER BE LOST.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE APP IN THE TWELVE MONTHS BEFORE THE CLAIM (OR USD $0 IF THE APP IS FREE).
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.
13. Indemnity
You agree to indemnify and hold us harmless from claims arising out of your misuse of the App, your content, or your violation of these Terms.
14. Governing law
These Terms are governed by the laws of Kenya. Any disputes arising out of or related to these Terms or your use of the App will be resolved in the competent courts of Kenya, unless applicable law requires otherwise.
15. Final Terms
These Terms are the final version currently in effect for THRYVE.
